On behalf of the members and Board of Directors of Wisconsin =
Towns Association I want to request that you sign SB 87 (relating to =
annexation law changes) and AB 551 (relating to town approval of county =
development plans) into law. Our Association supports both of these =
bills as by the legislature and believe that both bills have positive =
benefits not only for towns but other interests in the state.=20
=20
SB 87 is a very modest attempt to encourage cooperation and =
more boundary agreements between towns and neighboring cities and =
villages. The taxpayer cost of boundary conflicts to date is simply =
unacceptable. Wisconsin Towns Association has long strived to push for =
these types of incentives to encourage cooperation which allows for long =
term effective land use planning and reduces the local taxpayer cost =
resulting from annexation disputes.=20
SB 87 modifies the current annexation law to provide that for =
annexations after the effective date of this bill, cities and villages =
must pay the town for five years the amount of the town tax in the last =
year before the annexation unless the city/village has a boundary =
agreement with the town. This provision will encourage more cities and =
villages to consider boundary agreements with towns in the future. =
Intergovernmental cooperation between towns and neighboring cities or =
villages should be encouraged. We need to point out that the =
amount of payments in many cases may be minimal amounts. If the land =
that is annexed is agricultural land under use value assessment the =
value may be only $300 to $500 per acre. The average tax rate for towns =
is about $2.50 per thousand of value. Therefore the payment per acre may =
only be $.75 to $1.25 per acre annexed per year. When cities and =
villages complain about having to make payments it is really because =
they do not want to give up any power over annexation. =20
SB 87 will not stop any annexations because the city or =
village can either make payments for the amount of lost town taxes or =
enter a boundary agreement. It is truly our hope that more boundary =
agreements will be entered.=20
SB 87 also prohibits cities and villages from annexing land =
from towns in neighboring counties that the city or village is not =
already in that county. There are two exceptions to this prohibition =
which would allow the annexation into a new county if both the town =
board and the county board approves or the town has a boundary agreement =
and the county board approves. This provision will encourage =
cooperation. The issue of cities and villages going into new counties =
causes as much concern for county services as it has impacts on towns.=20
In summary, SB 87 will encourage boundary agreements between =
towns and neighboring cities and villages. We ask your support in this =
by signing SB 87 into law.=20
=20
AB 551 that before the county development plan (also =
referred to as the comprehensive plan) or any amendments to the plan =
are effective in a town, the town board must approve the plan for their =
town. This does not apply to shoreland, wetland, or floodplain zoning. =
Therefore the county plan will still be applicable within shoreland, =
wetland, or floodplain areas. =20
Wisconsin Towns Association supports AB 551 because we =
believe that it will encourage more cooperation between towns and =
counties, rather than allowing counties to impose plans on towns. We =
have encouraged towns to work together with counties in developing =
comprehensive plans. In many counties this has been working well. The =
county officials have often for example in Portage County and Marathon =
County, stated that they want to incorporate the town comprehensive =
plans into the county plans. AB 551 will protect towns and reinforce =
what many county planners have been saying.=20
In some of the more rural counties, smaller towns still be =
encouraged to work with the county in developing the county plan, but if =
these small rural towns do not have land use regulations (such as =
zoning, or are under county zoning, or subdivision/land division =
ordinances) the town will not be required to adopt a comprehensive plan =
but under AB 551 have a say in what the county plan is that applies to =
them. This can be a cost saving for smaller rural towns, yet insure =
that these towns have input into the county plan, which in the end =
insures acceptance of the county plan by those most effected.=20
In summary, AB 551 will encourage more cooperative town and =
county relationships in the planning process. This type of cooperation =
is both cost effective and supports strong comprehensive planning =
statewide. =20
Wisconsin Towns Association respectfully requests that you =
sign both SB 87 and AB 551 into law. If you or your staff have any =
