Dear Governor Doyle:=20

           On behalf of the members  and Board of Directors of Wisconsin =
Towns Association I want to request that you sign SB 87 (relating to =
annexation law changes) and AB 551  (relating to town approval of county =
development plans) into law.   Our Association supports both of these =
bills as  by the legislature and believe that both bills have positive =
benefits not only for towns but other interests in the state.=20

=20

           SB 87  is a very modest attempt to encourage cooperation and =
more boundary agreements between towns and neighboring cities and =
villages. The taxpayer cost of boundary conflicts to date is simply =
unacceptable. Wisconsin Towns Association has long strived to push for =
these types of incentives to encourage cooperation which allows for long =
term effective land use planning and reduces the local taxpayer cost =
resulting from annexation disputes.=20

           SB 87 modifies the current annexation law to provide that for =
annexations after the effective date of this bill, cities and villages =
must pay the town for five years the amount of the town tax in the last =
year before the annexation unless the city/village has a boundary =
agreement with the town.   This provision will encourage more cities and =
villages to consider boundary agreements with towns in the future. =
Intergovernmental cooperation between towns and neighboring cities or =
villages should be encouraged.         We need to point out that the =
amount of payments in many cases may be minimal amounts.  If the land =
that is annexed is agricultural land under use value assessment  the =
value may be only $300 to $500 per acre. The average tax rate for towns =
is about $2.50 per thousand of value. Therefore the payment per acre may =
only be $.75 to $1.25 per acre  annexed per year.  When cities and =
villages complain about having to make payments it is really because =
they do not want to give up any power over annexation.  =20

           SB 87 will not stop any annexations because the city or =
village can either make payments for the amount of lost town taxes or =
enter a boundary agreement.  It is truly our hope that more boundary =
agreements will be entered.=20

           SB 87 also prohibits cities and villages from annexing land =
from towns in neighboring counties that the city or village is not =
already in that county.  There are two exceptions to this prohibition =
which would allow the annexation into a new county if both the town =
board and the county board approves or the town has a boundary agreement =
and the county board approves. This provision will encourage =
cooperation.  The issue of cities and villages going into new counties =
causes as much concern for county services as it has impacts on towns.=20

           In summary, SB 87  will encourage boundary agreements between =
towns and neighboring cities and villages. We ask your support in this =
by signing SB 87 into law.=20

=20

           AB 551   that before the county development plan (also =
referred to as the comprehensive plan) or any amendments to the plan  =
are effective in a town, the town board must approve the plan for their =
town.  This does not apply to shoreland, wetland, or floodplain zoning.  =
Therefore the county plan will still be applicable  within shoreland, =
wetland, or floodplain areas. =20

           Wisconsin Towns Association supports AB 551 because we =
believe that it will encourage more cooperation between towns and =
counties, rather than allowing counties to impose plans on towns.  We =
have encouraged towns to work together with counties in developing =
comprehensive plans.  In many counties this has been working well.  The =
county officials have often for example in Portage County and Marathon =
County, stated that they want to incorporate the town comprehensive =
plans into the county plans.  AB 551 will protect towns and reinforce =
what many county planners have been saying.=20

           In some of the more  rural counties, smaller towns  still be =
encouraged to work with the county in developing the county plan, but if =
these small rural towns do not have land use regulations (such as =
zoning, or are under county zoning, or subdivision/land division =
ordinances)  the town will not be required to adopt a comprehensive plan =
but under AB 551 have a say in what the county plan is that applies to =
them.   This can be a cost saving for smaller rural towns, yet insure =
that these towns have input into the county plan, which in the end =
insures acceptance of the county plan by those most effected.=20

           In summary, AB 551 will encourage more cooperative town and =
county relationships in the planning process.   This type of cooperation =
is both cost effective and supports strong comprehensive planning =
statewide.  =20

           Wisconsin Towns Association respectfully requests that  you =
sign both SB 87 and AB 551 into law.  If you or your staff have any =

association leadership  would be very willing (upon limited notice) to =

ities&nbsp;and&nbsp;villages&nbsp;complain&nbsp;about&nbsp;having&nbsp;to=
&nbsp;make&nbsp;payments&nbsp;it&nbsp;is&nbsp;really&nbsp;because&nbsp;th=
ey&nbsp;do&nbsp;not&nbsp;want&nbsp;to&nbsp;give&nbsp;up&nbsp;any&nbsp;pow=
er&nbsp;over&nbsp;annexation.&nbsp;&nbsp;&nbsp;<BR><BR>&nbsp;&nbsp;&nbsp;=
&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;SB&nbsp;87&nbsp;<U>will&n=
bsp;not</U>&nbsp;stop&nbsp;any&nbsp;annexations&nbsp;because&nbsp;the&nbs=
p;city&nbsp;or&nbsp;village&nbsp;can&nbsp;either&nbsp;make&nbsp;payments&=
nbsp;for&nbsp;the&nbsp;amount=20
of&nbsp;lost&nbsp;town&nbsp;taxes&nbsp;or&nbsp;enter&nbsp;a&nbsp;boundary=
&nbsp;agreement.&nbsp;&nbsp;It&nbsp;is&nbsp;truly&nbsp;our&nbsp;hope&nbsp=
;that&nbsp;more&nbsp;boundary&nbsp;agreements&nbsp;will&nbsp;be&nbsp;ente=
red.=20
<BR><BR>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp=
;SB&nbsp;87&nbsp;also&nbsp;prohibits&nbsp;cities&nbsp;and&nbsp;villages&n=
bsp;from&nbsp;annexing&nbsp;land&nbsp;from&nbsp;towns&nbsp;in&nbsp;neighb=
oring&nbsp;counties&nbsp;that&nbsp;the&nbsp;city&nbsp;or&nbsp;village&nbs=
p;is&nbsp;not&nbsp;already&nbsp;in&nbsp;that&nbsp;county.&nbsp;&nbsp;Ther=
e&nbsp;are&nbsp;two&nbsp;exceptions&nbsp;to&nbsp;this&nbsp;prohibition=20
which&nbsp;would&nbsp;allow&nbsp;the&nbsp;annexation&nbsp;into&nbsp;a&nbs=
p;new&nbsp;county=20
if&nbsp;both&nbsp;the&nbsp;town&nbsp;board=20
and&nbsp;the&nbsp;county&nbsp;board&nbsp;approves&nbsp;or&nbsp;the&nbsp;t=
own&nbsp;has&nbsp;a&nbsp;boundary&nbsp;agreement&nbsp;and&nbsp;the&nbsp;c=
ounty&nbsp;board&nbsp;approves.&nbsp;This&nbsp;provision&nbsp;will&nbsp;e=
ncourage&nbsp;cooperation.&nbsp;&nbsp;The&nbsp;issue=20
of&nbsp;cities&nbsp;and&nbsp;villages&nbsp;going&nbsp;into&nbsp;new&nbsp;=
counties&nbsp;causes&nbsp;as&nbsp;much&nbsp;concern&nbsp;for&nbsp;county&=
nbsp;services&nbsp;as&nbsp;it=20
has&nbsp;impacts=20
on&nbsp;towns.&nbsp;<BR><BR>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nb=
sp;&nbsp;&nbsp;&nbsp;In&nbsp;summary,&nbsp;SB&nbsp;87&nbsp;&nbsp;will=20
encourage&nbsp;boundary&nbsp;agreements&nbsp;between&nbsp;towns&nbsp;and&=
nbsp;neighboring&nbsp;cities=20
and&nbsp;villages.&nbsp;We&nbsp;ask&nbsp;your&nbsp;support&nbsp;in&nbsp;t=
his&nbsp;by&nbsp;signing&nbsp;SB&nbsp;87&nbsp;into&nbsp;law.=20
<BR><BR>&nbsp;<BR><BR>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nb=
sp;&nbsp;&nbsp;<B>AB&nbsp;551&nbsp;</B>&nbsp;&nbsp;that&nbsp;before&nbsp;=
the&nbsp;county&nbsp;development&nbsp;plan&nbsp;(also&nbsp;referred&nbsp;=
to&nbsp;as&nbsp;the&nbsp;comprehensive&nbsp;plan)&nbsp;or&nbsp;any&nbsp;a=
mendments&nbsp;to&nbsp;the=20
plan&nbsp;&nbsp;are&nbsp;effective=20
in&nbsp;a&nbsp;town,&nbsp;the&nbsp;town&nbsp;board&nbsp;must&nbsp;approve=
&nbsp;the&nbsp;plan&nbsp;for&nbsp;their&nbsp;town.&nbsp;&nbsp;This&nbsp;<=
U>does&nbsp;not&nbsp;apply</U>&nbsp;to&nbsp;shoreland,&nbsp;wetland,&nbsp=
;or&nbsp;floodplain&nbsp;zoning.&nbsp;&nbsp;Therefore&nbsp;the&nbsp;count=
y&nbsp;plan&nbsp;will&nbsp;still&nbsp;be&nbsp;applicable&nbsp;&nbsp;withi=
n&nbsp;shoreland,&nbsp;wetland,&nbsp;or&nbsp;floodplain&nbsp;areas.&nbsp;=
&nbsp;<BR><BR>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp=
;&nbsp;Wisconsin&nbsp;Towns&nbsp;Association&nbsp;supports&nbsp;AB&nbsp;5=
51&nbsp;because&nbsp;we&nbsp;believe&nbsp;that&nbsp;it&nbsp;will&nbsp;enc=
ourage&nbsp;more&nbsp;cooperation&nbsp;between&nbsp;towns&nbsp;and&nbsp;c=
ounties,&nbsp;rather&nbsp;than&nbsp;allowing&nbsp;counties&nbsp;to&nbsp;i=
mpose&nbsp;plans&nbsp;on&nbsp;towns.&nbsp;&nbsp;We&nbsp;have&nbsp;encoura=
ged&nbsp;towns&nbsp;to&nbsp;work&nbsp;together&nbsp;with&nbsp;counties&nb=
sp;in&nbsp;developing&nbsp;comprehensive&nbsp;plans.&nbsp;&nbsp;In&nbsp;m=
any&nbsp;counties&nbsp;this&nbsp;has&nbsp;been&nbsp;working=20
well.&nbsp;&nbsp;The&nbsp;county&nbsp;officials&nbsp;have&nbsp;often&nbsp=
;for&nbsp;example&nbsp;in&nbsp;Portage&nbsp;County=20
and&nbsp;Marathon&nbsp;County,&nbsp;stated&nbsp;that&nbsp;they&nbsp;want&=
nbsp;to&nbsp;incorporate&nbsp;the=20
town&nbsp;comprehensive&nbsp;plans&nbsp;into&nbsp;the&nbsp;county&nbsp;pl=
ans.&nbsp;&nbsp;AB&nbsp;551&nbsp;will&nbsp;protect&nbsp;towns&nbsp;and&nb=
sp;reinforce=20
what&nbsp;many&nbsp;county&nbsp;planners&nbsp;have&nbsp;been&nbsp;saying.=

<BR><BR>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp=
;In&nbsp;some&nbsp;of&nbsp;the&nbsp;more&nbsp;&nbsp;rural&nbsp;counties,&=
nbsp;smaller&nbsp;towns=20
&nbsp;still&nbsp;be&nbsp;encouraged&nbsp;to&nbsp;work&nbsp;with&nbsp;the&=
nbsp;county&nbsp;in&nbsp;developing&nbsp;the&nbsp;county&nbsp;plan,&nbsp;=
but&nbsp;if&nbsp;these&nbsp;small&nbsp;rural&nbsp;towns&nbsp;do&nbsp;not&=
nbsp;have&nbsp;land&nbsp;use&nbsp;regulations&nbsp;(such&nbsp;as&nbsp;zon=
ing,&nbsp;or&nbsp;are&nbsp;under&nbsp;county&nbsp;zoning,&nbsp;or&nbsp;su=
bdivision/land&nbsp;division&nbsp;ordinances)&nbsp;&nbsp;the&nbsp;town=20
will&nbsp;not&nbsp;be&nbsp;required&nbsp;to&nbsp;adopt&nbsp;a&nbsp;compre=
hensive&nbsp;plan&nbsp;but&nbsp;under&nbsp;AB&nbsp;551&nbsp;have&nbsp;a&n=
bsp;say&nbsp;in=20
what&nbsp;the&nbsp;county&nbsp;plan&nbsp;is&nbsp;that&nbsp;applies&nbsp;t=
o&nbsp;them.&nbsp;&nbsp;&nbsp;This&nbsp;can&nbsp;be&nbsp;a&nbsp;cost&nbsp=
;saving&nbsp;for&nbsp;smaller&nbsp;rural&nbsp;towns,&nbsp;yet&nbsp;insure=
&nbsp;that&nbsp;these&nbsp;towns&nbsp;have&nbsp;input&nbsp;into&nbsp;the&=
nbsp;county&nbsp;plan,&nbsp;which&nbsp;in&nbsp;the&nbsp;end&nbsp;insures&=
nbsp;acceptance&nbsp;of&nbsp;the&nbsp;county&nbsp;plan&nbsp;by&nbsp;those=
